Environmental Assessment 380 South Worcester Road

Fuss & O’Neill assisted a major real estate client in its due diligence and ensuing environmental assessment for the acquisition of a large commercial property.

As part of acquisition due diligence we performed an ASTM Phase I Environmental Site Assessment (ESA) and Phase II ESA after uncovering potential issues such as floor drains in vehicle maintenance areas, historical spills on the property and former underground storage tanks (USTs). The characterization of the risk of harm to health, safety, public welfare and the environment demonstrated a level of No Significant Risk existed at the disposal site. The Response Action Performance Standard (RAPS) were met in accordance with 310 CMR 40.0191. A Method 3 Risk Characterization supported a Permanent Solution.

Our client successfully acquired the property and was able to mitigate financial exposure to unknown environmental conditions.
